I kindly ask if you've had the chance to review our listing in its entirety, including the house rules? It's essential to ensure that our guests have all the necessary information for a comfortable and enjoyable stay. Additionally, as part of our booking process, we require guests to comply with our house rules and vacation rental agreement. The agreement is listed below and under other details to note. Little Miss Myrtle Short Term Vacation Rental Agreement This Vacation Short-Term Rental Occupancy Agreement (“Agreement”) constitutes a contract between the undersigned person (“Guest”, “you”) and North By South Rentals LLC (“Owner”)for the dates listed within the reservation. This contract is not transferable. It is understood and expressly agreed Owner is providing a short-term occupancy accommodation and expressly disclaims any responsibility for any acts or omissions by third persons or other legal entities for the provision of any services, goods, or other products which may be provided during the term of this agreement. Owner and its representatives are in no way responsible or otherwise liable for services beyond the normal operation of the property as a short-term occupancy accommodation. GUESTS IMPLICIT UNDERSTANDING: By booking this reservation, guests agree to communicate this agreement to everyone in their party and abide by its terms. OWNER PROVIDED AMENITIES & BENEFITS We will provide for our guest’s enjoyment and use:  Linens & bath towels  Starter kit including restroom soap, and starter size dish soap, cleaning sponge, dishwashing tablets, laundry tablets and dryer sheets, and one paper towel  1 roll of fresh toilet paper per restroom  Cleaning products under the sink and broom with pan, vacuum, and mop with bucket for use during your stay  Feel free to bring your beach towels, toys, chairs or other items for your stay. Owner does not supply beach equipment. Do not bring bath towels to the beach.  Ring Doorbell camera, driveway camera, and back porch camera present on site. No cameras in the interior of the home.  Only 6 cars allowed in driveway. Guests must not block sidewalk. Do not park on grass  All trash is to be bagged, and placed inside Trash Bins.  Traveler’s Insurance is highly recommended. Any job, weather, family death, illness, or other Acts of God related reasons for not being able to fulfill reservation, will not be honored, and guests will not be issued refunds outside of the refund window.  Bi-weekly lawn care occurs on the 1st and 3rd week of the month during business hours. Due to their independent operations, we can't provide specific day confirmations to guests about their visits, and they are not required to announce their arrival when servicing the property. Availability of amenities not guaranteed, such as hot tub, Game room games, TVs, mini golf, etc. All items do require intermittent maintenance and sometimes break down. CHECK-IN: is at 3pm and is self-check-in. Check-in may be delayed for maintenance or special cleaning. Early check-in are not permitted for summer months May- September, plan accordingly. CHECK-OUT: All belongings must be removed from the property, hot tub area and exterior area, must be vacated by 11 AM. A late check-out may be available for a fee but must be communicated to owner and approved in advance. Any items left behind requiring shipping will be the sole responsibility of the guest. Retrieval of left behind property is not guaranteed. CHECK-OUT INSTRUCTIONS: Prior to departure, you are required to (1) remove all items from the freezer and refrigerator; (2) run the dishwasher; (3) ensure the grill is cleaned, (4) carry out all trash and place in the bins provided; (5) close and lock all windows and doors, leaving the property in a secure and orderly condition. NO NEED TO STRIP BEDS OR PILE TOWELS. We will take care of the rest. The guest making the reservation is required to stay for the duration of the reservation. House parties are not permitted. There is an implicit expectation that those renting are 25 and older and are going to be on premise and take the ultimate responsibility for the home and property. You are not permitted to rent the home on behalf of your family or friends under the age of 25 as you will take on all of the liability. Should these requirements not be met, or in any way falsified, immediate eviction and forfeiture of rents and deposits will occur. Any reservation obtained under false pretense will be subject to forfeiture of all payments, deposits and/or rental money, and the party will not be permitted to check in or may be evicted. Evictions are not subject to any refunds, including security deposit or damage deposit. MECHANICAL FAILURES AND INCONENIENCES: Owner attempts to properly maintain the Property. While all electrical and mechanical equipment within the Property are in good working order, Owner cannot guarantee against mechanical failure of electrical service, stopped plumbing, water supply, heating, air conditioning, audio visual equipment, internet access, cable service, or appliances. Guest agrees to report any inoperative equipment or other maintenance problem to Owner immediately. Owner will make every reasonable effort to have repairs done quickly and efficiently. Guest will allow Owner or a person permitted by Owner access to the Property for purposes of repair and inspection. Owner is not responsible for any inconvenience that may occur and no refunds or rent reductions will be made due to failure of such items. Examples of inconveniences which fall outside our control and do not warrant any refund of rental monies include, but are not limited to: breakdown of TVs, satellite systems, stereos, hot tubs, pools, or other appliances; poor cleaning issues; outages of power, cable, internet, water, or telephone services; construction activities in the vicinity; presence of flies, ladybugs, stink bugs, or other insects inside the house; chipmunks, mice, or other rodents inside the house; inclement weather conditions including snow, sleet, rain, and fog; sub-optimal beach conditions; hazardous road conditions. Acts of God: If there is a storm or severe weather and a mandatory evacuation order is issued by state or local authorities, Guest shall be entitled to a prorated refund for each night Guest is unable to occupy the Property. Owner will not be liable or deemed in default under this Agreement for any failure to perform or delay in performing any of its obligations due to or arising out of any act not within its control, including, without limitation, acts of God. INCLEMENT WEATHER: Hurricanes & Tropical Storms: Given the location of our properties, we acknowledge the possibility of inclement weather conditions including, but not limited to, hurricanes and tropical storms. In the event of an official evacuation order due to hurricanes or tropical storms, guests are required to vacate the property. We do not offer refunds for inclement weather, however, we strongly recommend guests purchase travel insurance which may cover the cost of your reservation should your trip be disrupted or canceled due to weather-related events or other unforeseen circumstances. If a hurricane or tropical storm disrupts electrical, water, or other utilities at the property, North By South Rentals will make every effort to notify the relevant authorities and work towards restoring these services. However, no refunds or compensation will be given for temporary loss of these services caused by weather conditions beyond our control. We strive to ensure the comfort and safety of our guests, and we appreciate your understanding and cooperation in these circumstances. Please stay informed about the weather conditions during your stay and heed all advisories and orders issued by local authorities. Your safety is our utmost priority. HOT TUB: NO DIVING ALLOWED. There is NO LIFEGUARD ON DUTY – SWIM AT YOUR OWN RISK. There is a hot tub located on the property. You will use the hot tub at your own risk. Owner will not be held responsible for the injuries sustained by you, anyone in your group or your visitors when using the hot tub, and you will indemnify Owner for any actions resulting from injuries to you or anyone in your group. No children should be in or around the hot tub without adult supervision. Please ensure all doors and/or gates giving accessibility. The hot tub is heated with the rental of the home. Our hot tub is maintained by a trusted third-party company. Due to their independent operations, we can't provide specific day confirmations to guests about their visits, and they are not required to announce their arrival when servicing the property. Hot tubs have electrical/mechanical components. These components can sometimes malfunction. North By South Rentals cannot be held responsible for any malfunctioning hot tub. Please inform us as soon as possible if your pool or hot tub is not working properly. No compensation will be given for a malfunctioning spa. North By South Rentals will do everything in its power to rectify any problems with malfunctioning equipment as quickly as possible. All pool equipment must be operated by a licensed professional. Due to their independent operations, we can't provide specific day confirmations to guests about their visits, and they are not required to announce their arrival when servicing the property. CHANNEL HOME LIABILITY: Guests acknowledge and agree that the rental property may be situated near or adjacent to a channel or body of water, which may present certain hazards, including but not limited to uneven terrain, slippery conditions, and risks associated with water activities. Guests assume full responsibility for their own safety and the safety of all members of their party and agree to exercise caution when navigating the channel or any natural areas on the rental property. North By South Rentals shall not be liable for any injuries, damages or losses arising from the use of the channel or any natural areas on the rental property. Guests agree to indemnify and hold harmless North By South Rentals from any and all claims, damages, or expenses arising from any injuries, damages or losses incurred while on the channel or any natural areas on the rental property. Guests are strongly advised to exercise caution and ensure that all individuals in their party are aware of the potential hazards associated with the channel or any natural areas on the rental property. SUPPLY STARTER KIT: To ensure your first night with us is comfortable, we've provided a starter kit of essential supplies. This is just a little something to help you settle in. Please note, this kit is intended to cover your immediate needs upon arrival. For the duration of your stay, you may want to bring or purchase any additional items you require. TV/STREAMING: The property features smart TVs with access to streaming apps like Netflix, YouTube, and more. Please note that guests need to use their own accounts for these services. We do not provide cable TV – streaming options only. Enjoy your entertainment experience! CANINE-FRIENDLY: Bring your furry friends along for the exciting vacation! We happily accept dogs of all shapes and sizes. This covers up to 2 pets for the duration of the stay. To ensure cleanliness and avoid additional cleaning fees, we kindly request that owners promptly pick up their pets' waste and refrain from allowing pets on beds and furniture. NO PARTIES/EVENTS: We kindly ask you to treat our home as your own to preserve its pristine condition for future guests and your return visits. Any guests found to be hosting an event or party will be subject to immediate eviction without the possibility of reimbursement. CELEBRATION DECOR: When using celebration decor (i.e. balloons, posters, streamers) within the home you must use proper wall and/or ceiling 3m type strips or the like which do not damage surfaces. Scotch tape or any other tape is not permitted. Please ensure all decor used inside or outside the home is removed and cleaned up prior to departure. Failure to remove and/or clean celebration decor could incur an additional cleaning fee of $150. Any damage to surfaces requiring repair or replacement are the Guests responsibility. CONTRABAND & WEAPONS: There are to be NO illegal activities, drugs, or contraband used or brought onto the premises at any time. If any evidence is found we will notify the police and your reservation will be canceled with no recourse or refund. Weapons aren’t permitted on the property including but limited to firearms with or without a concealed weapons permit. Any harm done by any weapons including but not limited to firearms are your sole liability and responsibility. Canceled reservations are not subject to any refunds, this includes security deposits and damage waivers. You are responsible for the actions of everyone in your party. TOILETS: only toilet paper should go in the toilet. A trash bin has been provided in each restroom for everything else. Clogged toilets as a result of Guest negligence may incur a minimum fee of $150 up to the cost of repair. NO DAILY HOUSEKEEPING SERVICE: While linens and bath towels are included in the rental, daily housekeeping service is not included. It is our priority to ensure the rental property is properly cleaned and sanitized prior to your arrival. If the cleanliness of the property upon check-in does not meet your expectations, please notify us on the platform you used to book immediately. We will dispatch a housekeeper as quickly as possible. Please note that NO REFUNDS will be granted for unsatisfactory housekeeping, but every effort will be made to promptly address and rectify your concerns. PEST CONTROL: The home is treated by pest control on a routine basis to ensure the comfort and safety of our guests. While we take measures to prevent pest infestations, it's important to note that occasional encounters with pests may occur. Guests are encouraged to promptly report any pest sightings to the Owner for immediate action. LANDLINES: NO landline phone is available TENTS AND CABANAS: Are not permitted on the beach in North Myrtle Beach 5/15-9/15. Similar rules apply in Myrtle Beach, other nearby coastal towns, and Horry County. Always be sure to check with the city of North Myrtle Beach prior to travel for updates regarding rules and regulations and/or change of dates. NOISE ORDINANCE: It is illegal in the City of North Myrtle Beach to generate any sustained or repetitive noise, no matter the source, “that is audible beyond the property line between the hours of 11 p.m. and 7 a.m., when, in the opinion of the responding official, such noise is excessive, disrupting the peace, or disturbing the general public. Due to this noise ordinance, monitors have been installed in/around the house in efforts to resolve the noise violation before officials can be called. If warnings are disregarded officials will be called to intervene. LIMITATION ON LIABILITY: Owner is not responsible for any accidents, injuries or illness that occur to any member of the Rental Party or Guest’s visitors while in the Property or on the Property. Owner is not responsible for loss of personal belongings or valuables belonging to any member of the Rental Party or any of Guest’s visitors. Guest agrees to assume the risk of any harm arising from use of the Property. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, INCLUDING TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, SHALL OWNER BE LIABLE TO GUEST OR ANY OTHER PERSON FOR ANY DAMAGES OF ANY NATURE WHATSOEVER INCLUDING ARISING OUT OF OR RELATING TO THIS AGREEMENT OR GUEST’S RENTAL OF THE PROPERTY OR USE OF THE ICONNECTION WITH THIS AGREEMENT, EVEN IF OWNER SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE. INDEMNIFICATION: Guest acknowledges that the use of the Property by the Rental Party and Guest’s visitors is entirely at their own risk. Guest will indemnify and hold harmless Owner from any and all expenses, costs, damages, suits, actions, or liabilities whatsoever arising from or related to any and all loss of or damage to personal property, including injury or death resulting from the use or occupancy of the Property or the failure of any member of Rental Party or Guest’s visitors to observe the rules and restrictions set forth in this agreement VIOLATION OF AGREEMENT: If Guest or any member of the Rental Party violates any of the terms of this Agreement, including but not limited to maximum occupancy, visitors and rental rules and restrictions, Owner may evict Guest and the Rental Party from the Property and Guest will forfeit all rent and security deposit paid. GOVERNING LAW: This Agreement and all transactions contemplated by this Agreement will be governed by, and constructed and enforced in accordance with the laws of the State of South Carolina (not including its conflicts of laws provisions). Any dispute arising from this Agreement shall be resolved through mediation. If the dispute cannot be resolved through mediation, then the dispute will be resolved through binding arbitration conducted in accordance with the rules of the American Arbitration Association. GUESTS IMPLICIT UNDERSTANDING: By booking this reservation and/or signing this agreement the guest recognizes their responsibility to communicate this agreement with everyone in their party whom will stay in the home and that they have received each individuals agreement to abide by and be personally liable for everything contained within this agreement and house rules. Due to their independent operations, we can't provide specific day confirmations to guests about their visits, and they are not required to announce their arrival when servicing the property. CHANNEL HOME LIABILITY: Guests acknowledge and agree that the rental property may be situated near or adjacent to a channel or body of water, which may present certain hazards, including but not limited to uneven terrain, slippery conditions, and risks associated with water activities. Guests assume full responsibility for their own safety and the safety of all members of their party and agree to exercise caution when navigating the channel or any natural areas on the rental property. North By South Rentals shall not be liable for any injuries, damages or losses arising from the use of the channel or any natural areas on the rental property. Guests agree to indemnify and hold harmless North By South Rentals from any and all claims, damages, or expenses arising from any injuries, damages or losses incurred while on the channel or any natural areas on the rental property. Guests are strongly advised to exercise caution and ensure that all individuals in their party are aware of the potential hazards associated with the channel or any natural areas on the rental property. SUPPLY STARTER KIT: To ensure your first night with us is comfortable, we've provided a starter kit of essential supplies. This is just a little something to help you settle in. Please note, this kit is intended to cover your immediate needs upon arrival. For the duration of your stay, you may want to bring or purchase any additional items you require. TV/STREAMING: The property features smart TVs with access to streaming apps like Netflix, YouTube, and more. Please note that guests need to use their own accounts for these services. We do not provide cable TV – streaming options only. Enjoy your entertainment experience! CANINE-FRIENDLY: Bring your furry friends along for the exciting vacation! We happily accept dogs of all shapes and sizes. This covers up to 2 pets for the duration of the stay. To ensure cleanliness and avoid additional cleaning fees, we kindly request that owners promptly pick up their pets' waste and refrain from allowing pets on beds and furniture. NO PARTIES/EVENTS: We kindly ask you to treat our home as your own to preserve its pristine condition for future guests and your return visits. Any guests found to be hosting an event or party will be subject to immediate eviction without the possibility of reimbursement. CELEBRATION DECOR: When using celebration decor (i.e. balloons, posters, streamers) within the home you must use proper wall and/or ceiling 3m type strips or the like which do not damage surfaces. Scotch tape or any other tape is not permitted. Please ensure all decor used inside or outside the home is removed and cleaned up prior to departure. Failure to remove and/or clean celebration decor could incur an additional cleaning fee of $150. Any damage to surfaces requiring repair or replacement are the Guests responsibility. CONTRABAND & WEAPONS: There are to be NO illegal activities, drugs, or contraband used or brought onto the premises at any time. If any evidence is found we will notify the police and your reservation will be canceled with no recourse or refund. Weapons aren’t permitted on the property including but limited to firearms with or without a concealed weapons permit. Any harm done by any weapons including but not limited to firearms are your sole liability and responsibility. Canceled reservations are not subject to any refunds, this includes security deposits and damage waivers. You are responsible for the actions of everyone in your party. TOILETS: only toilet paper should go in the toilet. A trash bin has been provided in each restroom for everything else. Clogged toilets as a result of Guest negligence may incur a minimum fee of $150 up to the cost of repair. NO DAILY HOUSEKEEPING SERVICE: While linens and bath towels are included in the rental, daily housekeeping service is not included. It is our priority to ensure the rental property is properly cleaned and sanitized prior to your arrival. If the cleanliness of the property upon check-in does not meet your expectations, please notify us on the platform you used to book immediately. We will dispatch a housekeeper as quickly as possible. Please note that NO REFUNDS will be granted for unsatisfactory housekeeping, but every effort will be made to promptly address and rectify your concerns. PEST CONTROL: The home is treated by pest control on a routine basis to ensure the comfort and safety of our guests. While we take measures to prevent pest infestations, it's important to note that occasional encounters with pests may occur. Guests are encouraged to promptly report any pest sightings to the Owner for immediate action. LANDLINES: NO landline phone available TENTS AND CABANAS: Are not permitted on the beach in North Myrtle Beach 5/15-9/15. Similar rules apply in Myrtle Beach, other nearby coastal towns, and Horry County. Always be sure to check with the city of North Myrtle Beach prior to travel for updates regarding rules and regulations and/or change of dates. NOISE ORDINANCE: It is illegal in the City of North Myrtle Beach to generate any sustained or repetitive noise, no matter the source, “that is audible beyond the property line between the hours of 11 p.m. and 7 a.m., when, in the opinion of the responding official, such noise is excessive, disrupting the peace, or disturbing the general public. Due to this noise ordinance, monitors have been installed in/around the house in efforts to resolve the noise violation before officials can be called. If warnings are disregarded officials will be called to intervene. LIMITATION ON LIABILITY: Owner is not responsible for any accidents, injuries or illness that occur to any member of the Rental Party or Guest’s visitors while in the Property or on the Property. Owner is not responsible for loss of personal belongings or valuables belonging to any member of the Rental Party or any of Guest’s visitors. Guest agrees to assume the risk of any harm arising from use of the Property. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, INCLUDING TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, SHALL OWNER BE LIABLE TO GUEST OR ANY OTHER PERSON FOR ANY DAMAGES OF ANY NATURE WHATSOEVER INCLUDING ARISING OUT OF OR RELATING TO THIS AGREEMENT OR GUEST’S RENTAL OF THE PROPERTY OR USE OF THE ICONNECTION WITH THIS AGREEMENT, EVEN IF OWNER SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE. INDEMNIFICATION: Guest acknowledges that the use of the Property by the Rental Party and Guest’s visitors is entirely at their own risk. Guest will indemnify and hold harmless Owner from any and all expenses, costs, damages, suits, actions, or liabilities whatsoever arising from or related to any and all loss of or damage to personal property, including injury or death resulting from the use or occupancy of the Property or the failure of any member of Rental Party or Guest’s visitors to observe the rules and restrictions set forth in this agreement VIOLATION OF AGREEMENT: If Guest or any member of the Rental Party violates any of the terms of this Agreement, including but not limited to maximum occupancy, visitors and rental rules and restrictions, Owner may evict Guest and the Rental Party from the Property and Guest will forfeit all rent and security deposit paid. GOVERNING LAW: This Agreement and all transactions contemplated by this Agreement will be governed by, and constructed and enforced in accordance with the laws of the State of South Carolina (not including its conflicts of laws provisions). Any dispute arising from this Agreement shall be resolved through mediation. If the dispute cannot be resolved through mediation, then the dispute will be resolved through binding arbitration conducted in accordance with the rules of the American Arbitration Association. GUESTS IMPLICIT UNDERSTANDING: By booking this reservation and/or signing this agreement the guest recognizes their responsibility to communicate this agreement with everyone in their party whom will stay in the home and that they have received each individuals agreement to abide by and be personally liable for everything contained within this agreement and house rules. Guests violating any part of this agreement and house rules may, at the Owner's discretion, be subject to immediate removal from property without recourse. Guest agrees to vacate the property upon communication from the Owner by text, email, in person, the booking channel messaging system, or law enforcement instruction.
